Terms

These terms apply to the free scans, audits, fixes and monitoring provided by Tabwise. Tabwise is a sole trader business based in Cashel, Co. Tipperary, Ireland (“we”, “us”). Contact: hello@tabwise.ie.

If we agree different terms with you in writing, for example in a quote or statement of work, those take priority over these.

Our audits are a technical assessment of your website against the Web Content Accessibility Guidelines (WCAG). They are not legal advice. We can explain how WCAG relates to the European Accessibility Act and Irish accessibility law, but if you need advice on your legal obligations, speak to a solicitor.

No audit guarantees legal compliance. Accessibility depends on how a website changes over time, on content we didn’t review, and on how regulators and courts interpret the law. We report what we find in the pages and journeys we test, when we test them.

Free scans

A free scan is an automated check of a sample of your website’s public pages. Automated tools find only some accessibility issues, so a scan is not an audit and doesn’t show whether your site meets WCAG. The scan is free and places you under no obligation.

Quotes and scope

Before any paid work, we’ll send you a written quote setting out the pages and journeys in scope, what you’ll receive, the price and the timeline. Work starts when you accept the quote. Anything outside the agreed scope is quoted separately.

Audits

We test the agreed pages and journeys against WCAG 2.1 level AA, using automated tools, keyboard testing and screen reader testing, and send you a prioritised report. Findings reflect the site as it was when we tested it.

Fixes

When we fix issues for you, you need to give us the access we need, such as an admin account, a staging site or theme files. Please make sure you have a current backup before we start. We’ll take reasonable care not to disrupt your site, and we’ll retest every fix we make.

Fixes cover the issues in our report. They don’t cover later changes to your site, new content, or changes made by theme, plugin or platform updates after we’ve finished.

Monitoring

Monitoring is a monthly subscription, available after a Tabwise audit. It covers what’s described in your quote. You can cancel with 30 days’ notice by email.

Payment

Prices are in euro. Invoices are due within 14 days unless your quote says otherwise. We may ask for part of the fee up front for larger projects.

Your content and our work

You keep ownership of your website and its content. Once you’ve paid, you own the reports and accessibility statement we produce for you and can share them as you like. We keep the right to reuse our general methods, checklists and know-how.

Confidentiality

We keep your site access details and anything you tell us in confidence private. We only use them to do the work. Our privacy policy explains how we handle personal data.

Liability

We’ll carry out our work with reasonable skill and care. Our total liability to you for any claim about a piece of work is limited to the amount you paid us for that work. We’re not liable for indirect losses, such as lost profits or lost business, or for any fine, penalty or claim arising from your website’s accessibility.

Nothing in these terms limits liability that can’t be limited by law, or your statutory rights as a consumer.

Governing law

These terms are governed by Irish law, and the Irish courts have jurisdiction over any dispute.
